Върховният касационен съд – Търговска College was referred under paragraph 1 item 1 chl.125 vr.chl.124 JSA by the Minister of Justice of the Republic of Bulgaria with a request to rule on the question:

The Law on Religious Affairs (WA) of 2002 provided for judicial registration of religious communities as legal persons - Article 15 ZV. Entry in the public register under Article 18 ZV provided both emerging religious communities the acquisition status of legal entity - Art.14 WA, and the faiths that are registered under Article 6 of the repealed Act Religions (IOs), retain their status as legal persons.
In Article 10 paragraph 2 and ZV § 2 paragraph 3 of the TCP of the ZV, expressly excluded the Bulgarian Orthodox Church (BOC) on procedures for registration set out in Chapter III of the Act.

Legal logic suggests that after the Registry mode is off to religion, this scheme does not apply to its local branches. Аргумент в полза на такова тълкуване е и разпоредбата на чл.10 ал.2 предл.2 ЗВ, придаваща нормативна сила на Устава на БПЦ, който определя нейното устройство. Местните поделения – съставни части на БПЦ-БП, и техният правен статут като ЮЛ се определят от чл.13 на Устава - заварения от ЗВ Устав от 1949 год. и сега действащия Устав от 2009 год. The procedural order under § 2 paragraph 4 of TCP predl.3 of WA includes mandatory presentation of a document determined by the entry of religion in the register по чл.18 ЗВ, какъвто БПЦ-БП не може да представи, тъй като не подлежи на вписване в този регистър.
Поради изложените съображения, Общото събрание на Търговска колегия на Върховния касационен съд приема, че процедурата по § 2 ал.4 от ПЗР на ЗВ не се прилага за заварените местни поделения на Българската православна църква - Bulgarian Patriarchate.
