Karlsruhe (Deutschland), 21.12.2005 – Die Freisprüche des Landgerichts Düsseldorf im so genannten Mannesmann-Prozess gegen den ehemaligen Mannesmannchef Klaus Esser sowie den Vorstandssprecher der Deutschen Bank, Josef Ackermann, wurde heute vom Bundesgerichtshof (BGH) aufgehoben und zur erneuten Verhandlung an das Landgericht Düsseldorf zurückverwiesen.
Anlass des Prozesses waren die millionenschweren Abfindungen, die bei der feindlichen Übernahme des Röhren- und Mobilfunkkonzerns Mannesmann durch Vodafone gezahlt worden waren. Bei der Übernahme waren 57 Millionen Euro an Prämien und Abfindungen geflossen. Der Freispruch vom Vorwurf der Untreue an die Adresse der damaligen Führungsriege des Mannesmann-Konzerns durch das Landgericht Düsseldorf wurde vom Bundesgerichtshof auf Antrag der Bundesanwaltschaft aufgehoben. Das Landgericht Düsseldorf muss den Prozess neu aufnehmen.
